Standard rate. Under §542.060(a), an insurer that fails to comply with Subchapter B is liable for the claim amount plus interest at eighteen percent per annum as damages, together with reasonable and necessary attorney's fees.

Floating rate. Under §542.060(c), in actions to which Chapter 542A applies (property damage caused wholly or partly by forces of nature, with date of loss on or after Sept. 1, 2017), the rate is the §304.003 judgment rate plus five percent. The §304.003 rate floats with the prime rate, with a floor of 5% and a ceiling of 15%, producing a §542.060(c) penalty range of 10% to 20%.

Accrual. Interest accrues from the date the claim was required to be paid. The controlling deadline depends on which subchapter provision was breached: §542.055 (acknowledgment), §542.056 (acceptance/rejection), §542.057 (post-acceptance payment), or §542.058 (sixty-day catch-all).

Hinojos. See Hinojos v. State Farm Lloyds, 619 S.W.3d 651 (Tex. 2021): payment of an appraisal award does not extinguish liability for §542.060 interest on amounts that should have been paid earlier.
